§ 1. General provisions
1. These Regulations define the rules for using the Online Store available at https://ariahair.pl, including the rules for placing orders, concluding sales contracts, payments, delivery, the right of withdrawal and the complaint procedure.
2. The Online Store is run by:

3. The Seller sells products available in the Store, in particular premium hair products and accessories related to hair extensions and care.
4. Contact with the Seller is possible via e-mail at concierge@ariahair.pl and via WhatsApp at +97 1551141435.
5. The Regulations are made available to Buyers free of charge on the Store's website in a manner enabling their recording, downloading, storing and printing.
6. To use the Store, you must have a device with Internet access, active email, and a web browser that supports cookies.
§ 2. Definitions
1. Shop / Online Shop – online service available at https://ariahair.pl.
2. Seller – Aria Hair Daria Anna Karczewska, ul. Księżnej Zofii 14, 78-200 Białogard, NIP: 6722114294, REGON: 544510406.
3. Buyer – a natural person, legal person or organizational unit without legal personality who uses the Store or concludes a Sales Agreement with the Seller.
4. Consumer – a natural person making a purchase in the Store for purposes not directly related to his or her business or professional activity.
5. Entrepreneur with consumer rights – a natural person concluding a contract directly related to his/her business activity, if the content of this contract indicates that it is not of a professional nature for this person.
6. Product / Goods – a movable item available in the Store, which is the subject of the Sales Agreement.
7. Order – a declaration of will of the Buyer submitted via the order form, directly aimed at concluding a Sales Agreement.
8. Sales Agreement – a Product sales agreement concluded at a distance between the Buyer and the Seller via the Store.
9. Working days – days from Monday to Friday, excluding public holidays.
§ 3. Customer account
1. The Store can be used using a Customer Account or without registration, as a guest.
2. Creating an Account is voluntary and free of charge.
3. In order to create an Account, the Buyer provides the data required in the registration form, in particular the e-mail address and password.
4. The Buyer is obliged to provide true, current and factual information.
5. The Buyer is obliged to keep the Account login details confidential.
6. The Seller may delete the Account in the event of a gross violation of the Regulations by the Buyer, after prior notice to cease the violation.
§ 4. Placing orders
1. Orders can be placed in the Store 24 hours a day, 7 days a week.
2. In order to place an Order, the Buyer should:
a) select a Product available in the Store,
b) add the Product to the cart,
c) complete the order form, providing the data necessary to complete the Order,
d) choose the form of delivery and payment,
e) accept the Regulations,
f) click the button finalizing the Order with the obligation to pay.
3. Placing an Order by the Buyer constitutes an offer to conclude a Sales Agreement.
4. After placing the Order, the Seller sends the Buyer an e-mail confirming receipt of the Order.
5. The Sales Agreement is concluded upon confirmation of acceptance of the Order for execution by the Seller.
6. The Seller reserves the right to verify the Order, in particular in the case of Orders of significant value or raising reasonable doubts.
7. If the Order cannot be fulfilled, the Seller will inform the Buyer about this fact and propose a possible solution, including a refund of the payment made.
§ 5. Prices and payments
1. The prices of the Products given in the Store are gross prices and include VAT, if applicable.
2. Product prices do not include delivery costs, unless the Product description or information in the Store states otherwise.
3. The delivery cost is visible when placing the Order, before finalizing it.
4. The Buyer may make payment using the methods available in the Store at the time of placing the Order, in particular by electronic payments, payment cards, BLIK, online transfer or other methods provided by the payment operator.
5. The Seller reserves the right to change the prices of Products, organize promotions and cancel them, but these changes do not affect Orders placed before their introduction.
6. The sales document, if issued, may be sent to the Buyer in electronic form to the e-mail address provided.
§ 6. Delivery
1. The Seller delivers within the territory of the Republic of Poland and to selected foreign countries, in accordance with the delivery options available in the Store when placing the Order.
2. Delivery of Products takes place via carriers or logistics operators available in the Store.
3. The Order processing time depends on the availability of the Product, the selected delivery method and the country of delivery.
4. The estimated delivery time and delivery costs are presented to the Buyer when placing the Order.
5. The Seller informs the Buyer about the shipment of the Order via e-mail or other available communication channel.
6. The Buyer should inspect the condition of the shipment upon receipt. If any damage is visible, it is recommended that a damage report be completed with the carrier and the Seller be contacted.
§ 7. Right of withdrawal
1. The Consumer and the Entrepreneur with consumer rights have the right to withdraw from the Sales Agreement concluded at a distance within 14 days without giving any reason.
2. The deadline for withdrawal from the contract expires after 14 days from the date on which the Buyer came into possession of the Product or on which a third party indicated by the Buyer, other than the carrier, came into possession of the Product.
3. In order to exercise the right of withdrawal, the Buyer should inform the Seller of his/her decision by means of an unequivocal statement sent to the e-mail address: concierge@ariahair.pl or in writing to the following address: ul. Księżnej Zofii 14, 78-200 Białogard.
4. The Buyer may use the withdrawal form at the end of the Regulations, but this is not obligatory.
5. To meet the deadline, it is sufficient to send the declaration before its expiry.
6. In the event of withdrawal from the contract, the Seller shall return to the Buyer all payments received, including the cost of the cheapest standard delivery offered in the Store, no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract.
7. Refunds will be made using the same payment method used by the Buyer, unless the Buyer expressly agrees to a different solution.
8. The Seller may withhold reimbursement until the Product has been returned or the Buyer has provided proof of its return.
9. The Buyer should return the Product immediately, no later than 14 days from the date of informing the Seller about withdrawal from the contract.
10. The direct costs of returning the Product are borne by the Buyer, unless the Seller informs otherwise.
11. The Buyer is liable for any reduction in the value of the Product resulting from its use in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Product.
12. The right to withdraw from the contract may not apply in the cases specified in Article 38 of the Consumer Rights Act, in particular in relation to non-prefabricated Products, manufactured according to the Buyer's specifications or intended to meet his individual needs.
13. For reasons of hygiene and health protection, the right of withdrawal may not apply in relation to Products delivered in sealed packaging if the packaging has been opened after delivery and the Product cannot be returned for reasons of health protection or hygiene.
§ 8. Complaints
1. The Seller is responsible for the compliance of the Product with the contract in accordance with applicable law.
2. Complaints may be submitted electronically to the following address: concierge@ariahair.pl or in writing to: Aria Hair Daria Anna Karczewska, ul. Księżnej Zofii 14, 78-200 Białogard.
3. The complaint should include:
a) name and surname of the Buyer,
b) contact details,
c) Order number,
d) description of the non-conformity or defect of the Product,
e) Buyer's request.
4. The Seller will consider the complaint within 14 calendar days from the date of its receipt.
5. The Buyer will be informed about the procedure for handling the complaint via e-mail to the address provided in the complaint.
§ 9. Personal data
1. The administrator of the Buyers' personal data is Aria Hair Daria Anna Karczewska, ul. Księżnej Zofii 14, 78-200 Białogard, e-mail: concierge@ariahair.pl.
2. The Buyers' personal data are processed for the purpose of fulfilling the Order, processing payments, delivery, contacting the Buyer, handling complaints and returns, maintaining accounting records and pursuing or defending claims.
3. The legal basis for data processing is, in particular, the performance of the contract, the legal obligation of the Seller, the legitimate interest of the Seller and the consent of the Buyer, if granted.
4. The recipients of data may be entities operating the Store, payment service providers, courier companies, postal operators, accounting offices, IT service providers and other entities, when required by law.
5. The Buyer has the right to access data, rectify data, delete data, limit processing, transfer data, raise objections and file a complaint to the President of the Personal Data Protection Office.
6. Detailed information regarding the processing of personal data can be found in the Privacy Policy available in the Store.
§ 10. Cookies
1. The Store uses cookies to ensure the proper functioning of the website, remember user preferences, conduct statistics and conduct marketing activities, if the Buyer has consented to it.
2. The Buyer may change cookie settings in his/her web browser at any time.
3. Restricting the use of cookies may affect some of the Store's functionalities.
4. Detailed information about cookies can be found in the Cookies Policy available in the Store.
§ 11. Intellectual property
1. All content available in the Store, including text, photos, graphics, logos, trade names and visual elements, is protected by copyright or other intellectual property rights.
2. Copying, distributing, publishing or using the content of the Store without the Seller's consent is prohibited, except for cases permitted by law.
§ 12. Provisions regarding entrepreneurs
1. The provisions of this paragraph apply to Buyers who are not Consumers or Entrepreneurs with consumer rights.
2. In relation to entrepreneurs, the Seller's liability under the warranty is excluded to the extent permitted by law.
3. The court having jurisdiction to settle any disputes between the Seller and the entrepreneur is the court having jurisdiction over the Seller's registered office.
§ 13. Extrajudicial handling of complaints
1. The consumer has the option of using out-of-court complaint and redress procedures.
2. Information on out-of-court dispute resolution methods is available from municipal and district consumer ombudsmen, the Trade Inspection and consumer organizations.
3. The consumer may also use the ODR platform available at: https://ec.europa.eu/consumers/odr.
§ 14. Final provisions
1. The Regulations come into force on the date indicated at the beginning of the document.
2. The Seller reserves the right to change the Regulations for important reasons, in particular in the event of changes in legal provisions, changes in the operation of the Store, changes in payment methods, changes in delivery methods or the need to adapt the Regulations to technical and legal requirements.
3. Changes to the Regulations do not affect Orders placed before the date the changes enter into force.
4. Contracts concluded via the Store are concluded in Polish.
5. In matters not regulated by the Regulations, the provisions of Polish law shall apply.
6. The competent court for resolving disputes with Consumers is the court having jurisdiction under applicable law.
